ACCEPTANCE OF TERMS

These Terms of Use apply to any Garmin website or online service on which these Terms of Use are posted (collectively, the “Site”). By using the Site, you signify your agreement to these Terms of Use.

If you are a minor under the age of majority in your country of residence, you should review these Terms of Use with a parent or guardian.

We may modify these Terms of Use at any time by updating this posting. If we make a material change to these Terms of Use, we will notify registered users by email. Your continued use of the Site following the posting of revised Terms of Use means that you accept and agree to the changes. You should visit this page periodically to review these Terms of Use.

Note that different or additional terms might apply to some services or features offered on the Site. Those terms are posted in connection with the applicable service or feature. Any such terms are in addition to these Terms of Use, and in the event of a conflict, prevail over these Terms of Use.

RULES OF CONDUCT

You are responsible for your conduct on the Site. By using the Site, you agree to abide by our Rules of Conduct.

  • No Harm or Abuse of Others. You must not abuse, harass, or threaten anyone on the Site. You must not promote violence, terrorism, sexual assault, etc.Examples of Violations:
    • Engaging in bullying, stalking, or sexual harassment
    • Posting a threatening message, whether the threatened harm is physical, financial, or otherwise
    • Posting photos that depict animal torture
  • No Violation of Laws or Rights. You must abide by the law in your use of the Site. You must not defame another person, infringe their intellectual property rights, or violate their right to privacy.Examples of Violations:
    • Posting copyrighted content without permission of the copyright holder
    • Using the Site to collect personal information to sell or otherwise exploit for commercial purposes
    • Sharing another person’s personal information (such as their location or contact information) without their consent or for the purpose of harassment (i.e., “doxxing”)
    • Engaging in human trafficking, terrorism, disseminating child sexual abuse materials, trafficking in obscene or stolen material, drug dealing or drug abuse, harassment, theft, or conspiracy to commit any criminal activity
  • No Obscene, Profane, or Inappropriate Content. You must not post pornography, obscenity, profanity, or explicit descriptions or displays of nudity or activities.Examples of Violations:
    • Photos that depict genitalia
    • Photos that are intended to be sexually gratifying, even if containing no nudity
    • Content relating to bestiality
  • No Hate Speech. You must not post hate speech. “Hate speech” is content that attacks another person based on race, ethnicity, national origin, immigration status, caste, sexual orientation, sex, gender identity and expression, religion or faith, age, disability, serious disease, weight or size, pregnancy, or veteran status.Examples of Violations:
    • Using slurs, negative stereotypes, caricatures, or generalizations
    • Attacking another user based on their citizenship or country of origin
    • Calling for, or celebrating, violence against an ethnic group
    • Posting images or symbols associated with hate groups, such as swastikas
  • No Advertising. Except with Garmin’s prior written authorization, you must not use the Site for commercial activities or advertising, whether or not for a profit.Examples of Violations:
    • Sending or posting any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation, regardless of whether or not the recipient has consented to receive such messages
    • Running a giveaway or contest, without Garmin’s prior written authorization, for a prize with monetary value
    • Creating a profile on the Site that promotes a business
  • No Fraudulent or Deceptive Activity. You may not use the Site in a manner that constitutes fraudulent or deceptive activity.Examples of Violations:
    • Using multiple accounts to boost a rating of content on the Site
    • Participating in or organizing “review bombs” on the Site
    • Engaging in schemes to pay people to follow you or to post positive reviews
    • Faking activity results to win a reward or prize in a promotional contest
  • No Spam, Malicious Software, or Other Damaging or Disruptive Activity. You may not use the Site in any manner that could overburden, damage, impair, disable, or breach the security of any Garmin server or network, or interfere with anyone else’s use and enjoyment of the Site.Examples of Violations:
    • Uploading content that contains a virus or other harmful component
    • Attempting to gain unauthorized access to the Site, other accounts, or any systems or networks connected to the Site, whether through hacking or any other means
    • Using any process, whether automated or manual, that accesses, copies, or scrapes content from the Site through any means not purposely made available through the Site
    • Probing, scanning, or testing the vulnerability of the Site or any related system or network
    • Taking any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site, related systems or networks, or Garmin personnel
    • Making repetitive posts or posting off-topic content on a portion of the Site with a designated topic or theme
    • Creating, then deleting, then re-creating an account an excessive number of times
  • Do Not Impersonate Others. You must not impersonate anyone else on the Site or pretend to represent a person or organization that has not authorized you to act on their behalf.Examples of Violations:
    • Creating an account pretending to be someone else
    • Forging headers or otherwise manipulating identifiers to disguise the origin of any message you send to Garmin on or through the Site

If you violate these Rules of Conduct or otherwise breach these Terms of Use, we reserve the right to take the actions described below in Enforcement of these Terms of Use.

DISCLAIMER OF WARRANTIES

Garmin makes no representations or warranties about the accuracy, reliability, completeness, or timeliness of the Content or about the results to be obtained from using the Site and the Content. Any use of the Site and the Content is at your own risk.

GARMIN DOES NOT WARRANT THAT THE SITE WILL OPERATE ERROR-FREE OR THAT THE SITE OR THEIR SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL GOODS. IF YOUR USE OF THE SITE OR THE CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR LOSS OF PROFITS OR DATA, GARMIN WILL NOT BE RESPONSIBLE FOR THOSE COSTS.

THE SITE AND CONTENT ARE PROVIDED ON AN ‘AS IS’ BASIS WITHOUT ANY WARRANTIES OF ANY KIND. GARMIN, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF MERCHANTABILITY, NONINFRINGEMENT OF PROPRIETARY OR THIRD-PARTY RIGHTS, AND THE WARRANTY OF FITNESS FOR PARTICULAR PURPOSE.

GARMIN SHALL USE REASONABLE EFFORTS TO PROTECT INFORMATION OR DATA SUBMITTED BY YOU TO THE SITE IN CONNECTION WITH ANY SERVICE ON OR FEATURE OF THE SITE, BUT YOU ACKNOWLEDGE THAT TRANSMISSIONS USING THE INTERNET ARE NEVER COMPLETELY SECURE OR PRIVATE. YOU UNDERSTAND THAT ANY MESSAGE OR INFORMATION YOU SEND TO THE SITE, EVEN IF ENCRYPTED, MAY BE READ OR INTERCEPTED BY OTHERS. THEREFORE, YOUR SUBMISSION OF SUCH INFORMATION OR DATA IS AT YOUR SOLE RISK, AND YOU HEREBY RELEASE GARMIN FROM ANY AND ALL LIABILITY TO YOU FOR ANY LOSS OR LIABILITY RELATING TO SUCH INFORMATION IN ANY WAY.

GARMIN IS NOT RESPONSIBLE FOR ANY DATA CHARGES YOU MAY INCUR IN CONNECTION WITH YOUR USE OF ANY SERVICE ON OR FEATURE OF THE SITE.

DISCLAIMER OF CERTAIN DAMAGES

Your use of the Site is at your own risk. If you are dissatisfied with any of the Site, its contents, any service on, or feature of the Site or with these Terms of Use, your sole remedy is to discontinue use of the Site. IN NO EVENT WILL GARMIN, ITS LICENSORS, OR ANY THIRD PARTIES MENTIONED AT THE SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, INCIDENTAL, EXEMPLARY, AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE GARMIN SITES AND THE CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT GARMIN IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME COUNTRIES, STATES, OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR LOSS OR DAMAGE CAUSED BY GROSS NEGLIGENCE, PERSONAL INJURY OR DEATH, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU, IN WHICH CASE GARMIN’S LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT SUCH EXCLUSION OR LIMITATION IS ALLOWABLE UNDER THE APPLICABLE LAW. In no event shall the total liability of Garmin to you for all losses and damages, including for any implied warranties, exceed the greater of fifty U.S. dollars (US $50.00) or the total amount you paid Garmin to use any service on or feature of the Garmin Sites in the twelve months prior to the date of an initial claim made against Garmin.
